EU司法裁判所がダウンロード可能なゲームの再販を承認
著作権消尽の原則と著作権の境界
欧州連合司法裁判所は、消費者が以前に購入してプレイしたダウンロード可能なゲームおよびソフトウェアを合法的に再販できるとの判決を下しました。この判決は、ソフトウェア販売会社の UsedSoft と開発会社 Oracle との間で行われたドイツの裁判所の法的紛争に端を発しています。
裁判所によって確立された原則は、頒布権の消尽です (著作権消尽法理₁)。これは、著作権者がコピーを販売し、そのコピーを無期限に使用する権利を顧客に付与して再販を許可すると、頒布権が消滅することを意味します。
この判決は、Steam、GoG、Epic Games を介して EU 加盟国の消費者に適用されます。
